1. Introduction and Acceptance
By accessing or using OnlineOrder.pk's website, software, and services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. Definitions
- "Company" refers to OnlineOrder.pk.
- "Customer" refers to the restaurant, cafe, bakery, or cloud kitchen using our services.
- "Services" refers to online ordering systems, POS systems, mobile applications, and related software.
- "Subscription" refers to the monthly recurring fee for access to our services.
- "User" refers to any person accessing the website or services.
3. Account Registration
To use our services, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Be legally authorized to represent the restaurant business
4. Subscription and Payment Terms
- Subscriptions are billed monthly in advance.
- The initial 2-month advance payment is required for all plans.
- One-time app development fees are billed separately before development begins.
- Payments are non-refundable except as provided in the Refund Policy.
- We reserve the right to suspend services for non-payment.
- Prices are subject to change with 30 days' notice.
5. Service Level and Availability
- We strive for 99.9% uptime for our core services.
- Scheduled maintenance will be notified 48 hours in advance.
- We are not liable for downtime caused by third-party services (hosting, internet, payment gateways).
- Setup timelines are estimates and not guarantees.
6. Intellectual Property
- The OnlineOrder.pk platform, software, and code are our exclusive property.
- Your restaurant's website, app, logo, menu, and branding remain your property.
- You grant us a license to use your logo in our portfolio and marketing materials.
- You may not reverse engineer, copy, or resell our software.
7. Customer Responsibilities
- You are responsible for the accuracy of your menu and pricing.
- You must comply with all applicable laws and regulations.
- You may not use our services for illegal activities.
- You are responsible for fulfilling orders placed through your system.
- You must maintain accurate business and tax information.
8. Prohibited Activities
You may not use our services to:
- Sell illegal or prohibited products
- Engage in fraudulent or deceptive practices
- Violate any third-party intellectual property rights
- Distribute malware or harmful code
- Harass, abuse, or harm others
- Circumvent our security measures
9. Data Ownership and Privacy
Customer data collected through your ordering system belongs to you. Our Privacy Policy explains how we handle personal information.
10. Termination
- Either party may terminate with 30 days' written notice.
- We may terminate immediately for violation of these terms.
- Upon termination, you will lose access to your admin dashboard.
- Customer data can be exported before termination.
- App store listings will be removed 30 days after termination.
11. Limitation of Liability
To the maximum extent permitted by law, OnlineOrder.pk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services.
12. Indemnification
You agree to indemnify and hold harmless OnlineOrder.pk from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.
13. Modifications to Terms
We may modify these terms at any time. Material changes will be notified via email or dashboard notice. Continued use after changes constitutes acceptance.
14. Governing Law and Dispute Resolution
- These terms are governed by the laws of Pakistan.
- Any disputes shall be resolved through binding arbitration in Rawalpindi, Pakistan.
- Either party may seek injunctive relief in Pakistani courts.
